This Agreement is made and entered into by and between Versailles Maine Coon Royale Cattery (“Seller”), represented by breeder __________________, and __________________ (“Buyer”) for the sale and transfer of the Maine Coon kitten described below (“Kitten”). Collectively, the Seller and Buyer may be referred to as the “Parties.”

This Kitten is sold as a pet only, without breeding rights, unless otherwise agreed in writing.
This Agreement is governed by the laws of the State of Connecticut and the United States of America. This Agreement is executed in two counterparts, each of which shall be deemed an original and equally binding. It becomes effective upon signature by both Parties. Notarization is not required. The Parties agree that a facsimile or scanned color copy of this Agreement shall have the same legal force and effect as the original.

2. SALE CONDITIONS & HEALTH STATUS
2.1 The Kitten is sold “as is” and, to the best of the Seller’s knowledge, is healthy, socialized, and free of visible illness at the time of sale. A veterinary health certificate and vaccine/deworming record will be provided.
2.2 Once the full payment is made and the Kitten is in the Buyer’s possession (or with an approved courier), ownership and responsibility transfer to the Buyer.
2.3 All sales are final. Refunds or exchanges are only granted under specific health guarantees outlined in this Agreement.

3. BUYER OBLIGATIONS
Provide a clean, loving, indoor-only environment.
Ensure regular and emergency veterinary care.
Feed high-quality food appropriate to the Maine Coon breed.
Never declaw or perform unnecessary cosmetic alterations.
Rehoming Policy:
If the Buyer is ever unable to keep the Kitten for any reason, the Buyer must notify the Seller immediately. Under no circumstances may the Kitten be resold or surrendered to any third party—including shelters, pet stores, rescue organizations, or laboratories—without prior written consent of the Seller. The Seller reserves the right to reclaim the Kitten, and no refund or compensation shall be expected.

4. INITIAL VETERINARY EXAM & HEALTH RESPONSIBILITY
4.1 The Buyer agrees to take the Kitten to a licensed veterinarian for a wellness examination within seven (7) calendar days of receiving the Kitten.
4.2 If, during this exam, the Kitten is diagnosed with a life-threatening genetic or infectious condition, the Buyer must provide written documentation from the attending veterinarian. Upon verification, the Seller will offer either a replacement Kitten or store credit, at the Seller’s sole discretion. No reimbursement will be provided for medical or transportation expenses.
4.3 Failure to complete the veterinary examination within the 7-day period voids all health guarantees.
4.4 After the 7-day period, the Buyer assumes full responsibility for the Kitten’s health, care, and veterinary needs.

5. HEALTH GUARANTEES
FIP (Feline Infectious Peritonitis) Guarantee:
Death from confirmed FIP (via necropsy) within 6 weeks: Full replacement.
Death from FIP within 6 months: 50% store credit.
5.1 The Seller guarantees the Kitten is in good health for seven (7) calendar days after sale, provided the Buyer complies with Section 4.
5.2 After the 7-day period, the Seller bears no further responsibility for the Kitten’s health, development, behavior, or lifespan.
5.3 Exclusions include minor or treatable conditions, cosmetic traits, temperament, fertility, and conditions caused by accidents, negligence, improper care, or environment.
5.4 Guarantees apply only to the original Buyer and are non-transferable.
5.5 Genetic Testing & One-Year Genetic Health Warranty
The Seller warrants that all breeding adults of Versailles Maine Coon Royale Cattery have been genetically tested and confirmed negative for the most common hereditary feline diseases, including but not limited to:
Hypertrophic Cardiomyopathy (HCM)
Spinal Muscular Atrophy (SMA)
Pyruvate Kinase Deficiency (PKDef)
Furthermore, the Seller provides a one (1)-year Genetic Health Warranty from the date of the kitten’s delivery. This warranty covers congenital or hereditary conditions that may adversely affect the kitten’s health or quality of life, as confirmed by a licensed veterinarian.
If such a genetic or hereditary condition is diagnosed within the warranty period, the Buyer must provide written veterinary documentation within ten (10) days of diagnosis. Upon verification, the Buyer may choose between:
A replacement kitten of equal value (when available), or
A partial refund, mutually agreed upon by both parties.
This warranty does not cover non-genetic illnesses, viral or bacterial infections, injuries, or conditions caused by neglect, improper care, poor nutrition, or exposure to contagious environments after the kitten has left the Seller’s possession.

6. SPAY/NEUTER & BREEDING CLAUSES
6.1 The Buyer agrees to have the Kitten spayed/neutered between six (6) and nine (9) months of age and to provide the Seller with veterinary proof of procedure within fourteen (14) days.
6.2 Non-compliance may result in:
Repossession of the Kitten without refund, or
A breeding penalty of $6,000.
6.3 Breeding rights (if granted) must be set forth in a separate signed addendum.

7. DELIVERY & TRANSPORT
7.1 Kittens are released no earlier than nine (9) to eleven (11) weeks of age or upon veterinary approval.
7.2 All shipping costs are the responsibility of the Buyer.
7.3 Required documents include a health certificate (issued within 10 days of travel) and vaccine/deworming records.
7.4 Once the Kitten is in courier custody, the Seller bears no liability for transport-related delays, injury, or loss.

8. RETURNS & REHOMING
8.1 No returns or refunds will be granted due to personal issues (e.g., allergies, lifestyle changes).
8.2 If rehoming is required, the Seller must be notified first. No refund will be issued.
8.3 In cases of neglect, abuse, or unauthorized breeding, the Seller may demand the immediate return of the Kitten without compensation.

9. CONFIDENTIALITY, DISPUTE RESOLUTION & NON-DISPARAGEMENT
This section exists to encourage professional conduct and good-faith resolution of disputes, while protecting both parties from misleading or harmful statements.
9.1 Good-Faith Resolution
The Buyer agrees to make reasonable, good-faith efforts to raise and resolve any concerns or disputes directly with the Seller before publicly discussing the matter, including on social media or similar platforms.
9.2 Scope of Confidentiality
This section applies to non-public business information and private communications related to a dispute. It does not limit the Buyer’s ability to share truthful statements, honest opinions, lawful reviews based on personal experience, or disclosures required by law or made to professional advisors.
9.3 Confidentiality Concerns
If a concern arises regarding a potential breach of confidentiality, the parties agree to first address the issue cooperatively. A willful and material breach may be considered a violation of this Agreement, and appropriate remedies may be pursued where reasonably necessary.
9.4 Liquidated Damages – Confidentiality
The parties acknowledge that certain breaches of confidentiality may result in harm that is difficult to measure. In the case of a willful and material breach, liquidated damages of up to $10,000 may be awarded, subject to a determination of reasonableness and proportionality by the mediator, arbitrator, or court, in addition to any other remedies deemed appropriate.
9.5 Dispute Resolution
The parties agree to first attempt to resolve any dispute through informal discussion. If unresolved, the dispute may proceed to mediation. If mediation does not result in resolution, either party may pursue binding arbitration in Middlesex County, Connecticut, in accordance with applicable arbitration rules.
9.6 Governing Law
This Agreement shall be governed by the laws of the State of Connecticut.
9.7 Non-Disparagement
The Buyer agrees not to knowingly make false or misleading statements about the Seller or the Seller’s business that could reasonably be expected to cause material harm. This provision does not restrict truthful statements, honest opinions, or lawful reviews based on actual experience.
9.8 Liquidated Damages – Non-Disparagement
In the event of a willful and material violation of Section 9.7, liquidated damages of up to $10,000 may be awarded, subject to a determination of fairness and proportionality.

11. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the Parties. No oral statements or prior communications are binding. Amendments must be made in writing and signed by both Parties.
